EPR Compliance for Used Oil Management under the Hazardous and Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2023

Government of India has notified Hazardous and Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2023 by addition of Chapter-VII “Extended Producer Responsibility for Used Oil” vide MoEF&CC notification No. G.S.R 677(E) dated Sept 18, 2023 and has been commenced from 1st day of April, 2024. As per the said Rules, every Producer of Base Oil or Lubrication Oil and Importer of Used Oil shall have obligation of Extended Producer Responsibility to meet the respective targets of recycling the used oil in the country by purchasing extended producer responsibility certificates from registered recyclers to ensure environmentally sound management of used oil.

Producers must recycle a percentage of the base oil/lubrication oil sold or imported two years prior, increasing from 5% in 2024-25 to 50% from 2030-31 onwards.

Yes, used oil importers must recycle 100% of the used oil imported in the previous year.

Yes, white oil, process oils, and greases are exempt, but producers must still register on the Used Oil EPR Portal.

No, units exporting all their oil are exempt from EPR targets but must register on the EPR Portal.

Producers must purchase EPR certificates from registered recyclers via the CPCB portal.

No, EPR certificates are non-transferable between producers or used oil importers.

EPR certificates are valid for two years from the end of the financial year in which they were issued.

Environmental Compensation (EC) is imposed for:
